A Complex Product Liability Claims-Made Settlement

Product liability settlements often require unique claim validation solutions, such as utilizing proprietary technology to allow class members a way to upload required evidence.

In this claims-made settlement, Plaintiffs alleged that Cross Timbers Decking, DuraLife Decking, and Railways Railings manufactured between 2002 and 2012 were defective. Defendant GAF Materials Corporation (GAF) denied fault, wrongdoing and liability, but agreed to the MDL settlement to avoid expensive and protracted litigation.

Heffler Claims Group (Heffler) was chosen to handle the administration of this product liability settlement, responsible for the settlement website, contact center, claims process, and acting as the Special Master.

The contact center was structured utilizing an IVR script first, with an option to connect with a live agent for more detailed questions. This hybrid solution provided class members more options, especially for those looking for a live agent to answer specific questions or assist in the claims process. The settlement website offered class members the ability to upload photographic and video evidence, as well as contemporaneous documentation.

Heffler’s unique and extensive experience of serving as a Special Master in other cases played an important role in the decking claims process. It also allowed our team to provide comprehensive services that addressed every aspect of this building materials settlement administration.

Senior Director Mark Rapazzini, Esq. analyzes this settlement administration and offers perspective for future consumer product liability settlements in this case study.
